Lexmark Education Advancement Program Official Rules (Version: July 1, 2008)

These rules govern the Lexmark Education Advancement Program (“LEAP”). These rules are subject to change at any time by Lexmark International, Inc. (“Lexmark”) in its sole and absolute discretion. Changes will be communicated by posting a revised set of official rules through www.Lexmark.com/leap. Lexmark is not obligated to send individual notifications of changes to these official rules. Persons wishing to participate in the program must check the official LEAP website before making a purchase to see if the rules have changed.

Eligible Schools

In response to a qualifying purchase (see below), and subject to restrictions imposed by state, city, and/or county laws and/or regulations, Lexmark will make donations (see below) to any accredited public school (grades kindergarten through 12 only) located in the continental United States. At this time, schools having 501(c)(3) tax exempt status and schools that are part of an organization having 501(c)(3) tax exempt status are not eligible. Schools that are prohibited from participating because of law or regulation are not eligible. Lexmark in its sole and absolute discretion has the right to determine eligibility for enrollment.

Qualifying Purchases

Only purchases made by individuals who register for the LEAP program will qualify. Persons wishing to register must do so through www.Lexmark.com/leap.. At registration, registrants will be asked to designate an eligible, enrolled public school as their donation recipient. Failure to make this designation will render the purchase non-qualifying. In addition, designation of a non-eligible and/or non-enrolled school will render the purchase non-qualifying. A limit of one school designation per family/household/e-mail address applies. Only purchases made on the official LEAP website qualify, and the purchase must be of a Lexmark product that the official LEAP website identifies as eligible for LEAP donations. Purchases of any Lexmark product made anywhere other than on the official LEAP website do not qualify for LEAP donations. Qualifying purchases must be made within a Program Period (see below).

Program Period

There are two Program Periods each year: (a) May 1 through October 31, and (b) November 1 through April 31.

Donations

Twice per year, subject to restrictions imposed by state, city, and/or county laws and/or regulations, Lexmark will donate to each eligible, enrolled school that has been designated as a LEAP recipient an amount of money equal to five (5) percent of the purchase price paid (after excluding taxes, shipping costs, and credits for returned product) by all registrants making qualifying purchases (see above) during the immediately preceding Program Period and who at time of purchase have designated such school as their intended LEAP recipient; provided, if the donation amount would be less than $25, then Lexmark will wait to make a donation until the donation amount for all qualifying purchases in all prior Program Periods is $25 or more (subject to prior termination of LEAP). Any donations will be paid only by check payable only to eligible, enrolled recipient schools. Should a designated school, due to law, regulation, or otherwise, decline to participate, thus declining the donation, Lexmark will make an alternative donation to iloveschools.com, a non-profit entity. Iloveschools.com is not affiliated with Lexmark International, Inc., and registrants acknowledge and agree that Lexmark International, Inc. does not make any representations or warranties regarding iloveschools.com and is not responsible for its activities in any respect. Important

Donations made are not tax deductible by schools or purchasers. Notwithstanding any other language in the LEAP Official Rules to the contrary. Any donations, to the extent they occur, are gratuitous and purely voluntary only on the part of Lexmark International, Inc. Notwithstanding any other language herein to the contrary, nothing herein creates in Lexmark, LEAP registrants, or designated recipient schools any rights and/or obligations, whether in law or in equity. All donation checks must be cashed no later than the expiration date on the check. Lexmark will not replace checks dishonored by virtue of the fact that they were cashed post-expiration. Lexmark may modify or terminate the LEAP program at any time in its sole and absolute discretion.
